After fetal heart activity is detected, which occurs approximately six weeks into a pregnancy, the law prohibits abortions. Advocates for abortion rights claim that many women don’t know they’re pregnant until this point.
Texas Attorney General Ken Paxton asserts that the judge at the lower court exceeded his bounds.
“The district court’s injunction violates the separation of powers at every turn,” the court filing says.
Paxton would like the Fifth Circuit U.S. Court of Appeals to allow the law to be continued during appeals.
Clinics reportedlyAfter Wednesday’s ruling, abortions were offered within hours.
Paxton’s request is not yet being considered by the Appeals Court.
